Welcome to GearWise. These Terms of Service (“Terms”) govern your access to and use of the GearWise website, applications, and services (collectively, the “Service”). By accessing or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

You represent that you own or have the necessary rights to submit your User Content and that it does not violate the rights of any third party.

6. Third-Party Content and Links

The Service may display product specifications, reviews, pricing, and other information sourced from third parties. We strive for accuracy but do not guarantee the completeness, reliability, or timeliness of any third-party content. Links to third-party websites are provided for convenience; GearWise does not endorse and is not responsible for the content of linked sites.

7. AI-Generated Content

Certain features of the Service use artificial intelligence to generate recommendations, comparisons, and other content. AI-generated content is provided for informational purposes only and may contain inaccuracies. You should independently verify any information before relying on it for purchasing or safety decisions.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. GEARWISE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GEARWISE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM YOUR USE OF THE SERVICE. IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE GREATER OF ONE HUNDRED DOLLARS (US $100) OR THE AMOUNT YOU HAVE PAID GEARWISE IN THE TWELVE MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless GearWise and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your use of the Service or violation of these Terms.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any legal action arising under these Terms shall be brought exclusively in the federal or state courts located in Delaware.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page with a revised effective date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
